5.4. The basic directions of perfection of activity of police on interaction with institutes of a civil society at maintenance of constitutional laws and freedom of the person and the citizen in the Russian Federation

Carrying out of any reform in the state is always interfaced to search of the reasons of an unsatisfactory condition of a reformed element of system and ways of increase of efficiency of its functioning, its improvement kachest-vennogo conditions, its forms реорганизации1.

«Reform of the Ministry of Internal Affairs requires constant stimulation, because this process – as repair which is infinite. It can be ceased, but to finish it is impossible»,  the general director of the Center of the political information A.Muhin2 has noted.

Carried out reforming of system of the Ministry of Internal Affairs of Russia is natural process. For for a long time has already ripened requirement of the Russian society for trust increase to employees of law-enforcement bodies and improvement of quality of their activity. Effective mechanisms for maintenance of internal discipline and the external control, and also supervision of officials on law and order maintenance should «be created. Each body of protection of a public order should represent the public as a whole, bear before it responsibility and to be to it accountable» 3. For the social order of a society for police «in effect, – reduction of probability of fulfilment of crimes and offences in similar situations henceforth there where for this purpose there are corresponding conditions. Formulating the order for police in a similar way, the society should promote increase in the functional in every possible way

Police potential and if it is necessary – for connecting for increase of its efficiency and own possibilities »1.

In a science and practice there is a number of judgements that is useful to take advantage of a cooperation wide experience between police and the population modern for-rubezhnyh the countries for which are characteristic as individual participation of citizens in law and order protection, and collective forms of participation. Individual learning-stie citizens in law and order protection it can be carried out in the form of long-term cooperation within the limits of institute of volunteer assistants of police, and also as the disposable help expressed in the message of police of the information on unlawful conduct, about the noticed suspicious subjects and persons (Germany, the USA, etc.) . Among collective forms of participation are used such, as: 1) creation of points on maintenance of the law and order and the prevention pre-stupnosti (Japan); 2) formation of a police reserve (assistants) (USA); 3) the organisation of patrol of public places; 4) creation of kind-free teams and other public formations law-enforcement on-pravlennosti (Belarus, the Great Britain, the USA, Estonia, etc.); sotrudnichest-in with the private security enterprises (Peru), etc.

At the same time, unfortunately, attractive ideas, social hypotheses, the political technologies which have come from the West, do not work, or, on extreme me-re, do not give expected result in Russia. The reasons of it in the bases and oso-bennostjah lives of the Russian society and государства2. The priority should otda-vatsja to the person, its rights and freedom, instead of the power.

Follows will agree with opinion of some authors (O.A.Stepanov, R.B.Gladkih, A.V.Borisov, J.A.Ljaljakin) which consider, that orientation from police on observance and respect of the rights and freedom of the person and grazhda-nina in their activity should be considered as a necessary condition vypol-nenija by them of problems under the prevention of crimes. It defines cardinally new sight at a role, duties and police possibilities. Realisation of principle  «police on society service» assumes an emphasis on the prevention, preseche-nie, disclosing and investigation of crimes and administrative pravonaru -

The police urged to serve interests of a society as a whole, instead of any separately taken political party, religious or an ethnic group. Therefore for impartiality and neutrality maintenance so  legality, profes-sionalizma and absence of an arbitrariness in decision-making, independence in use of resources is given police at the decision of those or others about-blem1.

In law-enforcement bodies long time, for the purpose of improvement of the cores on-kazatelej works including on consolidation of legality, was skilful manipu-lirovanie the reporting indicators, not reflecting, as a rule, real on-lozhenija affairs. But gradually such reporting began to contradict obviously to real practice of investigation of crimes. The number of infringements of legality grew. The increasing force was typed by «shadow factors», representing itself as the reasons on legality. There was a certain system, practice, style naru-shenija legality. Among employees of law-enforcement bodies the professionalism pas-denie was observed, the legal nihilism amplified, widely extend-lo disbelief in a reality of such democratic principles, as: neprikosno-vennost persons, equality before the law, objectivity and impartiality of inquiry, preliminary investigation. All had more strongly an effect red tape, bureaucratism, the bribery, accruing social pressure on a society, etc. All these key factors also have served as the beginning of serious transformations.

It is known, that tragical incident of 2009 in the Moscow super-market where the major of militia Evsjukov has arranged shooting on visitors became a push to transformations to the Ministry of Internal Affairs of the Russian Federation. Dmitry Anatolevich Medvedev sojourning for that moment on a post of the President Grows-these, initiated scale reforming of the Ministry which should clear its numbers from «werewolves in epaulets» and raise, as a whole, effek-tivnost activity of the remained employees. On December, 24th, 2009 the Decree of the President of the Russian Federation № 1468 «About measures on perfection has been accepted

Activity of law-enforcement bodies of the Russian Federation »1. The given decree and the subsequent standard legal acts had been defined a complex of the measures directed on personnel and rear development of law-enforcement bodies, add-telnoe monetary stimulation of employees of law-enforcement bodies, obespe-chenie with habitation of employees, carrying out of a complex anticorruption mero-prijaty in system of the Ministry of Internal Affairs of Russia, creation of new, more perfect system of an estimation of activity of law-enforcement bodies, etc.

The basic attention has been given creation of new legal base the figure-nosti of police, to formation of perfect system of protection of its employees and members of their families. Extraordinary certification of 875,3 thousand the employees is spent, which result was considerable reduction (on 20 %) regular chis-lennosti law-enforcement bodies. In this connection the special Program of the Ministry of Internal Affairs of Russia «Social adaptation of employees of the law-enforcement bodies dismissed as a result of organizational-regular mero-prijaty, for 2011-2012» is prepared, accepted and reali-zovana.

In the course of large-scale modernisation of law-enforcement bodies at-njaty a number of the basic acts answering by all sushchest-vujushchim to the international standards of activity of police (federal acts «About police», «About social guarantees to employees of law-enforcement bodies of the Russian Federation and modification of separate acts of the Russian Federation», «About service in law-enforcement bodies of the Russian Fede-portable radio set and modification of separate acts Russian Fe-deratsii». However «the norm as those, will not have practical value until their maintenance and value by means of training and preparation and pu controls do not become a part of credo of each official on law and order maintenance» 2.

Reforming has entailed transformation of militia to police. At the same time, abundantly clear, that militia not so simply to "transform" into police  by simple renaming. First of all it is necessary me -

Despite all positive sides of reform, results reformiro-vanija, expected by a society, to put it mildly, are reached far not in full ob-eme, many problems remained, and they still should be solved. Infringements of office discipline and legality in police activity continue to take place. Quality of law-enforcement services leaves much to be desired by the population and uro-ven trust of citizens to police. And if in the near future (five-six years) si-tuatsija in law-enforcement bodies will not change, crisis of a law-enforcement sis-theme threatens to accept pathological forms. Police experts speak about inevitable loss of trust to employees of law-enforcement bodies, increase in quantity of crimes, decrease in level of safety in all spheres. This-day this problem is widely enough shined in mass-media, discussed on the most various уровнях2.

Level of fears of citizens concerning society criminalisation in 2013 has constituted 53 %. Not protected considered by 54 % of citizens. According to monitoring of 2013 only 29 % interrogated consider, that the life in Russia for till a year-two became more safe, and 53 % – that are more dangerous. Stably high share testing constant fears for the safety on uli-tsah and highways as in light (19 %), and during dark time of days (26 %) 3 remains.

To system of the Ministry of Internal Affairs of Russia and occurring transformations have not affected results of activity of its employees on protection and protection of the rights and freedom of the person and the citizen that causes the constant criticism of divisions of police from the wide public to the full. So, according to "Levada-centre" in 2013 65 % of the Russian citizens have not noticed changes in police work in on-slednie two года1. All it demands increase of efficiency of activity on-litsii, proceeding from real interests of the person and the citizen. It is thought, that vazh th direction of perfection of work of police in the given sphere is transition to the strategic planning including working out of programs, forecasts of development of all system of the Ministry of Internal Affairs of Russia for long prospect and their methodical maintenance.

It is necessary to notice, that strategic planning took place in system of the Ministry of Internal Affairs of the USSR, at the same time, for the reasons low prognoziruemosti, absence fi-nansirovanija the declared actions and necessary organizational nacha-la, and also weak orientirovannosti on the purpose of development has not provided dostizhe-nija due result.

Reforming of law-enforcement bodies in Russia has defined a vertical th structure of police and has led to monopolisation of public order protection by it. With a view of qualitative change of the developed situation expanded ra-bochaja the commission of experts formed at the Minister of Internal Affairs of the Russian Federation, has prepared offers on the further reforming of law-enforcement bodies of the Russian Federation. This document has been named by "Motoring map" 1.

Besides, with a view of change of a situation of the Ministry of Internal Affairs of Russia has developed the plan деятельности2 for 2013 and the planned period 2014-2018 which is generated on the basis of commissions of the President of the Russian Federation, containing in its Decrees from May, 7th, 2012 № 596-606, Basic directions of activity Pravi-telstva of the Russian Federation for the period till 2018 approved on January, 31st, 2013, other commissions of the President of the Russian Federation and the Government of the Russian Federation. The reference points presented in named documents are not uncontested and do not apply for the exhaustive decision of all problems facing to system of the Ministry of Internal Affairs of Russia. At the same time, they set the fashion to the forthcoming transformations as which skeleton mutual relations serve in system «police – a civil society».

Today, it is necessary to create all conditions for formation and funktsioni-rovanija the modern professional police answering to inquiries grazh-danskogo of a society, capable properly to provide konstitutsion -

11. Aktivizirovanie works of social councils at the Ministry of Internal Affairs of Russia and its territorial bodies, creation for them conditions of constructive work.

12. Work realisation on increase professional kvalifika-tsii employees, to eradication of system corruption which directly is connected with integration into the organised crime, expansion of participation in public personnel selection (the account of opinion of the population).

13. Carrying out of the adjusted policy of the Ministry of Internal Affairs of Russia in area formiro-vanija at the population of the impartial assessment of activity of police and creation polo -
