2.1. The international conventional regulation of transplantation for the purpose of bar of claim by lapse of time of illegal withdrawal and a turn of bodies of a human body

As it has been noted on passed in Vienna on October, 10-12th, 2011 Conferences of parties to the convention of the United Nations Organization against the transnational organised crime, illegal withdrawal and a turn of bodies and fabrics of a human body differs from other forms of a human trafic professional structure of dealers and the intermediaries participating in illegal circulation of bodies: besides the usual criminals who are a part of the majority of networks of illegal circulation, in trade in bodies happen doctors, other workers of public health services, and even drivers of ambulance cars are got quite often mixed up. As the transactions connected with transplantation of bodies, have rather difficult character, for their fulfilment experts from the most different areas are required. These participants among whom can be both physical, and legal bodies, play a different role in the course of illegal circulation – from direct participation in a human trafic with a view of withdrawal of bodies to the organisation and prompting of other persons to fulfilment of the given crime [95].

It causes that circumstance, that the norms mentioning withdrawal and a turn of bodies and fabrics of a human body, and also its illegal component, contain in international legal certificates of a different orientation.

Proceeding from the spent analysis of the maintenance of the international treaties mentioning problems of illegal withdrawal of bodies and fabrics of the person, they can be divided into three independent groups:

1) Conventions regulating questions of legitimacy of withdrawal of bodies and fabrics of a human body (the Convention of the Council of Europe «About protection of the rights and advantages of the person in connection with application of achievements of biology and medicine: the Convention on human rights and biomedicine» [96], the Additional report to «Conventions under human rights and biomedicine concerning transplantation of bodies and fabrics of the person» 2002) [97],

2) International legal certificates in sphere of protection of fundamental laws of the person - the right to life, on the medical aid reception, including treatment and leaving in medical institution («the General Declaration of human rights» 1948, is accepted by the resolution 217 And (III) General Assembly of the United Nations [98] «the International pact about the economic, social and cultural rights» 1966, the International pact about the civil and political rights »is accepted by the resolution 2200 And (XXI) General Assembly of the United Nations [99],« 1966, it is accepted by the resolution 2200 And (XXI) General Assembly of the United Nations [100], «the Convention on protection of human rights and fundamental freedoms» 1950 [101], the American Convention on human rights 1969 [102], the Social charter Northern and the South America 2012 [103], the African Charter of human rights and the people 1981 [104]);

3) International agreements in the field of counteraction of the states to illegal withdrawal and trade in bodies and fabrics of a human body («the Convention of the United Nations Organization against the transnational organised crime» 2000 [105], the Report on the prevention and human trafic suppression, especially women and children, and punishment for it, supplementing «the Convention of the United Nations Organization against the transnational organised crime» 2000 [106], «the Convention of the United Nations against corruption» 2003 [107], «the Convention of the Council of Europe on the criminal liability for corruption» [108], «the Convention of the Council of Europe on counteraction to a human trafic» 2005 [109], «the Convention of the Council of Europe on struggle against trade in bodies of the person» 2014 [110]).
