For creation enough the efficient interdepartmental system of social support of employees of police, maintenance in system of State Unitary Enterprise of Mongolia of unconditional, timely and full execution of requirements of the current legislation and the subordinate legislation standard legal acts regulating the organisation of social protection of members of families of victims and invalids, the prevention of the facts of a formalism and callousness in their relation, personnel service of State Unitary Enterprise of Mongolia is developed system of work with members of families of employees of police, victims at performance of official duties, and the employees who have become by invalids.

Certainly, this direction of activity inseparably linked with other directions of personnel work in police of Mongolia. To provide in foreseeable prospect their unity and independence, we believe the necessary have addressed to positive experience of the Ministry of Internal Affairs of Russia which has developed and has started realisation of the new concept of personnel selection of the Ministry of Internal Affairs of the Russian Federation (for the period till 2020). Careful studying of the text of the given document convinces of necessity of acceptance of the program specification similar to it at level of State Unitary Enterprise of Mongolia. At the same time we pay attention that the variant of the concept of personnel selection of the Ministry of Internal Affairs of Russia with reference to State Unitary Enterprise of Mongolia is required to be changed a little, considering gosudarstvennonatsionalnuju and administrative-territorial specificity of Mongolia (further - the Concept). In our opinion, first of all it is desirable to specify the Concept main objective, having added in its structure the elements constituting now the maintenance of personnel work in State Unitary Enterprise of Mongolia. [81]

Practically to realise the basic idea of the Concept, it is necessary, first of all, methodologically correctly, without logic ruptures, to formulate its basic concepts. So, in subparagraphs of point 6 of section 1 of the project, it is required to open the maintenance of such term - as personnel work that will allow to provide logic division of the widest on volume, key concept of the Concept - personnel selection.

From our point of view, such division should, in a general view, to be spent as follows: personnel selection, personnel work and work with staff which, on the one hand, will correspond with each other, as philosophical categories of the general, private and individual, and on the other hand, each of them, will have the internal structure, and as a whole, at their realisation, achievement the basic and the intermediate purposes of the Concept will be provided.

Concept realisation is a difficult process, its efficiency is provided with passage of corresponding stages and stages in the conditions of constant monitoring of results of work. Therefore it is desirable to add a considered variant of the Concept remedial constituting (stages, stages, terms) as Concept realisation is not that other as modernisation process. Told will allow to provide the basic value of the specified document - its concreteness and aiming at certain end results.

Besides, in the Concept basis, from our point of view, it is necessary to put scientifically proved, socially demanded universal model of the employee of police of Mongolia. The concept should suggest to generate «new is professional-moral shape of the employee of police of Mongolia», not forgetting thus to mention a society, as final "consumer" of results of such modernisation.

In the Concept the expected effect from its realisation should be specified not to admit transformation of consistently verified strategy in «the formal declaration on intentions».

At such approach is considered expedient to formulate following positions:

1) into point 1 of section I to enter a category of model of the employee of police;

2) in point 3 of section I to specify prospective result of realisation of the Concept in the form of formation of qualitatively new image of the future employee of police of Mongolia by the end of next decade;

3) in point 5 of section I to provide stages of realisation of the Concept: modelling and approbation, with instructions of the corresponding maintenance of stages of each stage;

4) in point 6 of section I to formulate key concepts of Concept realisation, having stated them in the following edition:

«6.1. Personnel selection of State Unitary Enterprise of Mongolia - a complex of ideas, principles and the standard rules providing effective personnel work in system of police. Personnel selection of State Unitary Enterprise of Mongolia is the integral component of the state personnel selection realised in State Unitary Enterprise by means of personnel work.

6.2. Personnel work in system of State Unitary Enterprise of Mongolia - activity of employees of personnel service and heads of bodies, the organisations and the divisions of State Unitary Enterprise of Mongolia which are subjects of personnel selection, directed on:

Formation of a control system by employees, the state civil employees, workers of bodies of police of Mongolia;

Optimum planning and direct realisation of work on selection of candidates worthy to be accepted on service (work) in bodies of police of Mongolia, to their corresponding check, reception, vocational training, placement of personnel, management of career and personnel growth of employees of bodies of police of Mongolia, formation of their normal moral and psychological climate office

Activity;

Maintenance of interaction with the employees transferred to the reserve and rendering assistance to invalids owing to a military trauma and to members of families of the lost employees;

Creation and effective functioning of system of vocational training, retraining and improvement of professional skill of staff of police of Mongolia.

6.3. Work with staff of bodies of police of Mongolia - purposeful activity of the administrative board of bodies, the organisations and divisions of State Unitary Enterprise of Mongolia on management and rational use of employees, the state civil employees, workers of bodies of police of Mongolia, with a view of the effective decision of operatively-office problems.

Creation of a normal moral and psychological climate in office collectives of bodies, the organisations, divisions of State Unitary Enterprise of Mongolia at the expense of strict observance of legality and maintenance of high level of office discipline, and also bar of claim by lapse of time of occurrence of the reasons and conditions of corruption displays;

Development in employees of state-patriotic outlook, complex of is professional-moral qualities of the person corresponding to structure of model of the employee of bodies of police of Mongolia;

Formation and preparation of the personnel reserves providing guarantees of career growth to employees, having the best indicators in work.

7.4. Personnel potential of State Unitary Enterprise of Mongolia - state possibilities in activity maintenance on protection of a life, health, the rights and freedom of citizens, criminality counteraction, protection of a public order, the property and public safety maintenance, the professional, highly skilled manpower resources corresponding on age, physical, moralnopsihologicheskim and the intellectual qualities of modern model of the employee of bodies of police of Mongolia.

6.5. Model of the employee of bodies of police of Mongolia - set of qualitative characteristics of the employee of bodies of police of Mongolia, defining its role and value in activity realisation on protection of a life, health, the rights and freedom of citizens, criminality counteraction, protection of a public order, the property and public safety maintenance, and also possibility and ability of the employee to effective execution of the official duties assigned to it ».

Structure and the maintenance of universal model of the employee of bodies of police of Mongolia in item 6.5. Section I are based on scientifically proved representations about elements administratively-legal status

6) the mechanism of realisation of personnel selection as a whole, and its elements in particular are defined in rules of law, therefore I to state item 6.10 of section as follows more correctly: «legal bases the mechanism of realisation of personnel selection of State Unitary Enterprise of Mongolia - set standard - the fixed forms, methods and means of maintenance of effective selection and placement of personnel, vocational training and moralnopsihologicheskogo maintenance of their office activity in bodies of police of Mongolia»;

7) in item 7 of section of II Concept it is necessary to specify, that personnel selection in system of State Unitary Enterprise of Mongolia is carried out not in interests of operatively-office activity, and in interests of a society and the state as personnel selection of State Unitary Enterprise of Mongolia is an integral part of a state policy of the country. Proceeding from it, ukaznyj it is necessary to state point in the following edition: «8. Personnel selection in system of State Unitary Enterprise of Mongolia is carried out with a view of creation, preservation, strengthening, development, rational and an effective utilisation of personnel potential of bodies of police of Mongolia in interests of a society and the state»;

11) in item 9 of section about complex personnel planning it is important to add II problem with words «taking into account a principle of obligatory rotation of shots»;

12) in item 9 of section II in addition to include following problems: «realisation by personnel divisions of work on informing of graduates of the educational organisations on specificity of service in bodies of police of Mongolia, about prestige of a trade of the policeman connected with protection of the rights and freedom of citizens, criminality counteraction, protection of a public order, the property and public safety maintenance, with obligatory carrying out of ispytatelno-estimated actions about an establishment of conformity of the graduate of concrete model of the employee of bodies of police of Mongolia; working out of profile models of the employee of bodies of police of Mongolia (on posts) and nauchnoobosnovannyh specifications, criteria of an estimation of efficiency of activity of the employee (collective of employees), on the basis of the account of actual loading on staff in each direction of office activity, and also public opinion».

The offered maintenance of key concepts, principles, the purposes, problems and legal mechanisms on the one hand, will allow to order logically Concept positions, and on the other hand, more accurately to define zones of responsibility of its practical realisation. So, the basic responsibility for results of personnel work, in our opinion, should be carried into the account of employees of personnel divisions and the heads allocated with the right of acceptance of personnel decisions in system of State Unitary Enterprise of Mongolia (subjects of personnel selection).

As to work with staff here the responsibility zone should be expanded, it is necessary for assigning to any heads of constant collectives in system of bodies, the organisations and divisions of State Unitary Enterprise of Mongolia (i.e. concerning not only to subjects of personnel selection). In these conditions it is possible to realise practically the purposes declared in the project, principles and personnel selection problems.

Summing up, we come to conclusion, that offered edition of the Concept of personnel selection of State Unitary Enterprise of Mongolia meets the requirements, shown to such sistemoobrazujushchim to documents and is capable to provide a public orientation, to observe logicality of a statement, to sustain a reality as at definition of the purposes and Concept problems, and at instructions of terms and ways of its realisation.

The done work has allowed the author of dissertation to offer independent treatment of the Concept of personnel selection which probably to consider as a basis for a formulation of the corresponding program standard document for police of Mongolia.

We believe, that similar use of the Russian experience of reforming of police as a whole, and perfection it is administrative - [82]

Legal protection of employees of police, in particular, will allow to improve the legislation of Mongolia in considered sphere.

Thereupon it would be quite defensible in the legislation of Mongolia to provide the similar Concept of personnel selection taking into account our remarks and additions, on purpose:

- Optimum definition of the rights, duties, and also mode of legal responsibility of bodies of police, and also their employees;

- Introductions of accurate procedures of acceptance of administrative decisions within the limits of social protection of employees of police and members of their families;

- Uses of a technique of the analysis of profile legal acts about them korruptsiogennosti;

- Explanations of social character of administratively-legal protection employees of police for a society, the state and citizens.

At the same time, it is necessary to notice, that for effective protection of employees of police to be limited to fastening at level of the legislation of the purposes, problems and principles of such activity would be obviously insufficiently.

J.S.Kostyrja in this connection notices, that efficiency of the mechanism of protection of employees of police, not being limited to quality of legal regulation, directly is connected with presence and adequacy of procedures of realisation of protective measures, expansion of sphere of the judicial review for

Social security of military men, being an element of the given system, also requires theoretical judgement. Studying of the theory of the state social security of military men represents special interest to interrelations with the characteristic of other organisation-legal forms of social protection of the population. It will allow to develop uniform approaches to the decision of some problems, the general for all system of social protection of the persons occupied with unproductive work, and will give the chance to illustrate most brightly caused by specificity of military service of feature of social security of military men.

V.M.Petrozhitsky establishes, that legal and social protection of employees it is necessary to consider as a priority direction of activity of the administrative board of corresponding bodies of police and a basic principle of work with shots. On a condition of legal and social security of employees and members of their families in modern conditions positive influence could render:

- Increase in the maximum limit of pension till the size of the monetary maintenance at achievement of a marginal level of a length of service;

- Introduction of progressive dependence between the size of a long-service pension and operation time over the target dates of service granting the right to a provision of pensions;

- Realisation of offers on introduction in law-enforcement bodies of system of target awarding;

- Working out and acceptance of the independent normative act in the form of the Code of laws «About the state guarantees, social privileges and advantages of employees of police and members of their families» [86 [87] [88].

It is necessary to notice, that it is possible to add this list with a position obliging indispensable studying by heads and officials of requirements of the current legislation, the normative acts of State Unitary Enterprise of Mongolia regulating the organisation social and a legal protection of members of families of victims and invalids owing to a military trauma.

State policy in sphere of social protection of invalids are subdivided into three groups. The first group characterises it by results and includes indicators of social security,

Economic and moral well-being of the given category of citizens. The second group characterises it from the point of view of an optimality and includes indicators of adaptability to manufacture of realisation of actions of a state policy, achievement on this basis of an optimum expenditure of resources allocated for it. Besides, in police administrations somonov (areas) it is required to develop programs of carrying out of rehabilitation of invalids owing to a military trauma with attraction of possibilities of medical institutions, Institute of police of University of law-enforcement service, State Unitary Enterprise of Mongolia, local administrations, territorial establishments of employment of the population, the public and charitable organisations. Concrete actions for improvement of their social position are carried out.

In our opinion, the organisation of social protection of employees of police should exclude possibility for employees of personnel service independently to involve sponsors (commercial structures) for rendering of the social (material) help to the employees, which steels invalids owing to a military trauma, and also to families of the lost employees. We believe, that all actions for social protection should be financed from the federal budget in a statutory order.

Behind timely registration of materials for manufacture of payments of lump sums and the sums insured provided by the current legislation to all employees of police, the victim on duty, and to members of families of the lost employees, it is necessary to carry out the departmental administrative and financial control.

Concerning perfection of a provision of pensions of employees of police, for more effective utilisation of means allocated for it, it is necessary to give to the main manager of budgetary funds (State Unitary Enterprise of Mongolia) the right to spend for a provision of pensions in coming budgetary year as additional means those means which under objective causes were not used in current budgetary year.

In system of the social help it is necessary to modernise the list of forms and methods of service of the social help, and also to develop short-term and long-term actions. Thus perfection in system of the social help should go in two directions: on the one hand, such system requires considerable decentralisation so that the social help appeared directly requiring, i.e. adresno. On the other hand, it is necessary to create such conditions at which able-bodied members of a society can independently solve the social problems.

Efforts on perfection of system of social service should be directed on expansion of an internal infrastructure of the centres of social service to provide individuality of the approach, quality and structure of social services. In the long term improvement of position of clients of social services should lean on complex gumanizirovannyj the approach to social service that means:

- Introduction by the state of the fixed list of the given

Obligatory services in social sphere;

- The rigid control from the state bodies behind social services for effective granting of the social help by them;

Thus, system of the organisation of social work as one of directions of protection of employees of police of Mongolia, regarding its legal maintenance provides streamlining and coordination of activity of all subjects of personnel work in State Unitary Enterprise of Mongolia, other, state bodies authorised on it and public associations, and also a standard recognition of the first priority of carrying out in system of State Unitary Enterprise of such actions as: social rehabilitations and adaptation of employees of police, victims on duty, and members of families of victims; medical maintenance; the organisation of the account of the persons who are coming under to protection; carrying out of monitoring social and economic and a legal status requiring protection. Realising these priorities, State Unitary Enterprise of Mongolia is capable to provide sufficient security of members of families of the employees who were lost on duty, and invalids owing to a military trauma, having transformed them in stably protected social group.

Creation of effective departmental system of social support of staff of police is a moral obligation of the state, heads of police, the major factor of strengthening moralnopsihologicheskogo conditions of employees of the police, expressed in constant care and the social help: to families of the employees who were lost on duty; to the employees, become [89] invalids owing to uvechy (wounds, traumas, contusions), the diseases received on duty in system of State Unitary Enterprise of Mongolia.

The basic functions of rendering of the social help and support from heads of police, heads educational, scientifically - research, medical and other establishments of system of State Unitary Enterprise of Mongolia are: maintenance of realisation of the social guarantees provided by the current legislation and creation of conditions for granting of the additional social help by public authorities, local government, public and charitable associations.

At the organisation of the social help the special attention should be given lonely aged parents, children-orphans, children - to invalids, parents-invalids, invalid widows of employees and the military men, lost (died) on duty (military service), to invalids owing to a military trauma and to their children.

For realisation of the social help it is necessary for employees of police, members of their families, that heads of police knew an order of fulfilment of actions on rendering of the social help to families of the employees who were lost on duty, and also to the employees who have become by invalids owing to a trauma, and were able to apply it correctly;

A little paraphrasing the statement of the Russian scientists about conditionality of perfection of mechanisms of social protection [90], it is possible to tell, that legal maintenance of system of social protection urged to lift level of satisfaction of material and spiritual interests of employees of police, to promote realisation of their rights, legitimate interests, duties and responsibility. It should be under construction taking into account features of national statehood of Mongolia, a current condition of development and formation of a society, a condition of reform of police, practical experience of controls, real possibilities and prospects.

In the course of working out of structure of social protection of employees of police of Mongolia it is necessary to consider the following recommendations formulated in due time by the Russian scientists [91]:

- The social protection structure should reflect the basic maintenance and directions of the social policy spent by state governing bodies in the country;

- The social protection structure should consider features of a concrete transition period in society development, its specificity and conditions of formation of new economic relations, including in regional aspect;

- Social protection should participate in formation of new standards of the way of life answering both national-cultural traditions, and formed new social relations actively;

- The social protection structure should have dynamical character, corresponding to changes in the maintenance of the state social policy;

- The social protection structure should be included in system of state regulation of economy both on federal, and at regional level.

In turn as expansion of financial possibilities in considered area of protection of employees of police of Mongolia it is possible to use: economy of the allocated resources; attraction of financial resources at the expense of formation of various funds under concrete social programs; sponsor's donations; new forms of crediting (reception in leasing of the equipment for carrying out of an automatic photo of fixing of infringements of rules of traffic); participation in creation of insurance funds on compulsory insurance of cars; cooperation of potential of law-enforcement structures in the field of social protection (joint insurance companies on obligatory and voluntary insurance of employees, etc.) ; Use of lawful forms of reception of additional incomes; rational use of property and the real estate; participation in the international programs in the area of law-enforcement activity; assistance of cooperation of employees of police in consumption sphere (gardening associations, housing construction, etc.).

It is necessary to consider, that the mentioned actions directed on perfection of is administrative-legal maintenance of protection of employees of police, are a part of the modern personnel selection spent in law-enforcement bodies of Mongolia, which bases of the Concept [92] developed by us, have received a positive estimation in State Unitary Enterprise of Mongolia and are partially realised in the educational organisations which are carrying out vocational training of employees of police of Mongolia.
